Participation in “The Edgewater Hotel & Casino’s VIP Vacation Getaway Sweepstakes” (“Sweepstakes”) constitutes full and unconditional agreement to and acceptance of these Official Rules. The Sweepstakes will begin at 12:00 a.m. Pacific Daylight Time February 25, 2008 and end at 11:59 p.m. Pacific Daylight Time on February 1, 2009. The Sweepstakes is sponsored by Edgewater Gaming, LLC dba Hotel & Casino (the “Edgewater”), located at 2100 South Casino Drive, Laughlin, Nevada, 89209.
1. NO PURCHASE NECESSARY: Except where prohibited by law and excluding Canada, the Sweepstakes is open to legal residents of the United States (except New York, Rhode Island, Florida, District of Columbia) who are 21 years of age or older at time of entry and as of February 25, 2008 had a valid email address. All federal, state, provincial and local laws and regulations apply. Void where prohibited. No written notices have been distributed, and the only official notice of the Sweepstakes is on this website.
2. HOW TO ENTER: Beginning at 12:00 a.m. Pacific Daylight Time February 25, 2008, you may enter the Sweepstakes by visiting the Edgewater website at http://www.edgewater-casino.com (“Web Site”) and completing the “Enter to Win” form. You must provide your name, a physical address and a valid email address for the submission to be valid (collectively, “entry information”). Only one (1) entry may be submitted per email address. To be eligible, entries for each month’s drawing must be received by 11:59 p.m. Pacific Daylight Time on the last day of the month and winners will be drawn on the first Monday of the following month. Non-winning entries will remain eligible for subsequent monthly drawings.
In the event of a dispute regarding the identity of the individual who submitted the entry information, the entry will be deemed submitted by the registered holder of the email account. Entrants are limited to one (1) entry in the Sweepstakes, regardless of how many email or home addresses the entrant possesses. Entrants using multiply entry programs will be disqualified from the Sweepstakes. Entrants illegally accessing the Web Site or Edgewater computers, or the web sites, web pages and/or computers of any of its affiliates, will be disqualified from the Sweepstakes and prosecuted to the fullest extent of the law.
3. PRIZES AND ESTIMATED TOTAL VALUE OF PRIZES: A maximum of ten (10) Package Prizes (“Prizes”) based on all winners accepting their prize will be awarded each month for the duration of the Sweepstakes, which is twelve (12) months. The value of each Prize is $293, with the maximum value being given away per month of $2,930. Each Prize includes: Two (2) free weekend or midweek nights in a river view room at the Edgewater in Laughlin, Nevada to be used by April 30, 2009 for the winner and a travel companion (subject to availability, excludes special event and holiday periods); $95 in dining certificates valid in either of the Edgewater’s two (2) restaurants (Hickory Pit Steakhouse or Grand Buffet, ); and $20 in free slot play (must be an ACCESS club member). A valid credit card will be required at check-in. Prizes are not transferable. No substitutions or cash alternatives for the Prizes are allowed. Any and all federal, state, provincial and local taxes on Prizes and incidental expenses, including but not limited to transportation, gratuities, meals, and long distance phone charges, are sole responsibility of the winner. All Prizes expire April 30, 2009, at which time all use of such Prizes must be completed. The odds of winning a Prize in a specific monthly drawing will depend on the number of eligible entries received for the specific drawing. There is no limit to the number of people who will be allowed to enter the Sweepstakes. All amounts are in US dollars.
4. THE WINNERS: A maximum of ten (10) winners, based on all winners accepting their prize will be selected at the end of each month in a random drawing among all eligible Sweepstakes entrants as detailed above and will be contacted by email within approximately ten (10) business days following the drawing. The drawings will be conducted by a computer generated random selection process among eligible entrants and will be overseen by Edgewater representatives. The decisions made by the Edgewater with respect to the winners and other matters pertaining to the Sweepstakes shall be conclusive and final. Entrants agree to be bound by these Official Rules and all decisions of the Edgewater. The winners will be required to complete, notarize and return an affidavit of eligibility/release of liability and publicity within ten (10) days of issuance of prize notification. Within three (3) business days of the Edgewater’s receipt of the winner’s completed and notarized Release, the Edgewater will send an email to the winner’s email address advising that he or she has complied with the Sweepstakes’ rules and that he or she is entitled to the Prize. Thereafter, the winner may contact the Edgewater’s Room Reservations Department at (866) 352-3553 to reserve a room. If the winner cannot be reached by email at the email address submitted, after two attempts have been made or if the winner is found to be ineligible, or if the winner cannot or does not comply with these Official Rules or the decisions of the Edgewater the prize will become void. By acceptance of the Prize, the winner consents to the use of his or her name, photography, likeness, biography, voice and or/video for advertising and promotional purposes, including online announcement, without additional compensation or limitation, except where prohibited by law. By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and by the decisions of the Edgewater. Failure to comply with these Official Rules or the decisions of the Edgewater will result in disqualification.
5. INELIGIBLE FOR THE CONTEST: Void in Florida, New York, Rhode Island the District of Columbia, Puerto Rico, all U.S. territories and possessions, Canada and where prohibited by law. Employees of the Edgewater, MARNELL SHER GAMING, LLC and their respective subsidiaries and affiliates, their immediate family (spouses, parents, siblings, children, and each of their respective spouses and household members) and those involved in creating, advertising, developing, producing, (including prize suppliers), implementing and distributing the Sweepstakes and their respective directors, officers, employees and agents and any other persons or entities directly associated with the Sweepstakes are ineligible to enter the Sweepstakes. All Federal, state, provincial and local laws and regulations apply.
6. CHANGE OF ADDRESS POLICY: It is the sole responsibility of the entrant to notify the Edgewater of a change in his or her address by emailing sweepstakes@edgewater-casino.com of such change during the applicable Sweepstakes period.
7. WINNERS LIST: The winners will be posted at http://www.edgewater-casino.com/08_sweepstakes.php within three (3) weeks of the drawing.
8. DISCLAIMERS: All participants and/or entrants release the Edgewater, MARNELL SHER GAMING, LLC and their respective subsidiaries and affiliates and their agents, employees, managers, members, officers, directors, and stockholders from and against all liability, claims and damages arising in connection with the participant’s or entrant’s participation, entry in the Sweepstakes and acceptance, receipt, ownership or use of any Prize awarded in the Sweepstakes as well as claims based on publicity rights, defamation or invasion of privacy. The Edgewater , MARNELL SHER GAMING, LLC and the person or entities involved with providing an entrant internet access are not responsible for incorrect, inaccurate or garbled entry information, human error, technical malfunctions, viruses, lost/delayed data transmission, omission, interruption, deletion, defect, network failures, computer equipment failure, software errors or any combination thereof, internet failures, inability to access the Web Site, printing errors or late, lost or incomplete entries. The Edgewater reserves the right to terminate the Sweepstakes for any or no reason and at any time without further notice.
9. APPLICABLE LAWS: The laws of the State of Nevada and the United States of America apply to and govern this Sweepstakes and any claims or actions in connection herewith must be brought in Clark County, Nevada. This Sweepstakes is void where prohibited.
